Clever Hawk, Inc., a Florida corporation, and its brand Palm & Petal (collectively, the "Company," "we," "us," or "our") operate under a strict privacy-by-design framework. This Privacy Policy and Data Security Statement applies entirely to our applications (the "App") available across mobile, tablet, and smart television platforms.

Our core software development has been executed by our engineering partners under strict instructions to prioritize user anonymity. We do not collect, store, track, or share any personal data from our users.

Because our App is designed for family audiences and children, we maintain the highest standards of data protection, in full compliance with the U.S. Children’s Online Privacy Protection Act (COPPA) and App Store Review Guidelines for Kids Category Applications.

1. ZERO PERSONAL DATA COLLECTION

We believe that children’s entertainment should be entirely free from corporate surveillance.

  • No Account Creation for Children: The App does not require, request, or permit children to enter names, email addresses, phone numbers, or any other personal identifiers.

  • No Behavioral Tracking: The App does not track user behavior across third-party websites or services. There are no software development kits (SDKs) embedded in the App designed for ad-tracking, profiling, or data mining.

  • No Video Tracking on Website: Our public website (palmandpetal.com) serves strictly as an informational portal. It hosts no video content, tracking pixels, or user-facing streaming feeds.

2. COOKIES AND LOCAL DATA STORAGE STATEMENT

We do not use tracking cookies, web beacons, or advertising identifiers (such as Apple's IDFA or Google's GAID).

  • App Local Storage Only: The App may utilize minimal, non-persistent local storage on your device (such as local cache or device-level memory) strictly to ensure performance stability, save application state (e.g., remembering which episode was paused), or maintain your preference settings.

  • Zero Cloud Extraction: This local data stays encrypted on your physical device. It is never transmitted back to Clever Hawk, Inc. or any external cloud server.

3. APP STORE COMPLIANCE & THIRD-PARTY SERVICES

  • No Advertisements: We display zero third-party commercial advertisements, removing any risk of accidental data collection by ad networks.

  • No In-App Purchases or Hidden Gates: There are no micro-transactions or hidden tracking mechanisms inside the App software.

  • Secure Gateways: Any external administrative functions (such as managing a parent subscription or updating account details) are locked behind an adult-targeted parental gate to ensure children cannot access external web browsers or payment processors. Payment data is processed exclusively and securely through the respective platform app stores (e.g. Apple App Store, Google Play).

4. DATA SECURITY INFRASTRUCTURE

The app has been engineered to capture zero data, we maintain rigorous security protocols to protect our platform infrastructure. We continuously audit our source code and deployment pipelines to ensure that no third-party libraries or background processes violate our zero-data mandate.

5. JURISDICTION AND VENUE

This Privacy Policy is governed by the laws of the State of Florida. Any disputes regarding data practices or platform security shall be resolved exclusively within the Eleventh Judicial Circuit Court in and for Miami-Dade County, Florida (or the United States District Court for the Southern District of Florida, Miami Division)
